Preliminary examination
UNDP/PAPP will examine the Proposals to determine whether they are complete, and whether they are substantially responsive to the qualification and experience minimum requirements. A Proposal determined as not substantially responsive will be rejected by UNDP/PAPP and may not subsequently be made responsive by the Applicant by correction of the non-conformity.
Detailed examination
A two-stage procedure is utilized in evaluating the proposals, with evaluation of the technical proposals prior to any financial proposal being opened and compared.
The technical proposals are evaluated on the basis of its responsiveness to the Terms of Reference (TOR).
Below please find the evaluation form for the technical proposals. The obtainable number of points specified for each evaluation criterion indicates the relative significance of weight of the item in the overall evaluation process.

In the Second Stage, UNDP/PAPP will open and evaluate the Financial Proposals received from applicants who attained the minimum technical score of 70% of the obtainable score of 100 points in the evaluation of their technical proposals.
Financial Proposal
Your financial offer in USD shall specify a lump sum figure (monthly salary) all inclusive, and shall take into account various expenses incurred during the contract period and shall form the amount of the resulted contract between the winning Consultant and UNDP. No other entitlements will be considered after submission of financial proposals.
The financial proposal shall include a breakdown of this lump sum amount (number of anticipated working days, all envisaged travel (such as but not limited to all travel to join duty station/repatriation travel), per diems/daily allowances). Fee Breakdown should be attached under a separate sheet.
Candidate is requested to submit the quotation on or before 10:00 a.m. on 17 November 2014 (Jerusalem Time). Submissions should be made either via/to e-mail address: quotation.papp@undp.org or to Fax No. 02-6268257 (If will be sent thru Email: File/Email size should not exceed 5 MB in a single email - quotation could be send by multiple emails as needed). Any submission of the financial proposal via any other mean will cause the whole application from the candidate to be rejected and disregarded.
Payments will be paid-out in equal monthly installments upon certification by the responsible officer.
Award of Individual Contract
The procuring UNDP entity reserves the right to accept or reject any Proposal, and to annul the solicitation process and reject all Proposals at any time prior to award of contract, without incurring any liability to the affected applicant or any obligation to inform the affected applicant or applicants of the ground for the UNDP’s action.
The procuring entity will award the Individual Contract to the applicant who attained the Highest Combined Technical and Financial weighted score.
However, final selection and contract award decisions are subject to the result of an interview (carried out by the evaluation committee) with the potential successful candidate.
The Combined score will be calculated as follows:
The total technical score is simply calculated by summing the scores attained for each evaluation criterion in the “evaluation criteria” table shown above.
The price/financial score for the financial proposal will be calculated in the following manner:
Where “x” is the price of the lowest proposal
And “y” is the price of any other proposal,
The percentage score for price allocated to the lowest priced proposal will be 100 points, and to any other proposal x/y times 100
The General mark or combined score for each proposal will be arrived as follows:
The total score of the Technical proposal multiplied by 70% will be added to the Financial Proposal score multiplied by 30%. The candidate whose proposal received the highest combined score will be the successful applicant.

Project Manager, Legal Empowerment, GoI- UNDP Project Access to Justice for Marginalized People (Open to Indian Nationals only) - New Delhi
Having made some progress towards reducing poverty and exclusion during the 11th Plan period, the 12th Plan aims to accelerate faster, sustainable and more inclusive growth. The Approach Paper to the Twelfth Five Year Plan points out that the “greater desire to access information about the rights and entitlements made available by law and policy, and eagerness to demand accountability from the public delivery systems augurs well for the future.”
UNDP has engaged in a partnership with the Department of Justice, Government of India, which began with a preparatory phase, Strengthened Access to Justice in India (SAJI) to carry out a justice sector diagnosis, identify entry points and support innovative small pilots to identify good initiatives for replication. Based on lessons and results of the first phase and an extensive design mission, a four year project (2008-2012) was developed. The project ‘Access to Justice for Marginalized People’ was implemented in the UNDAF focus states of Bihar, Chhattisgarh, Jharkhand, Madhya Pradesh, Orissa, Rajasthan and Uttar Pradesh as well as at national level with key institutions. A new phase of the Access to Justice Project has been launched for a period of 5 years.
The Department of Justice is taking many other steps to ensure improved access to justice for the people. An access to justice project has recently been rolled out in the 8 States of North-East India and in J & K. In addition, the Department has introduced a slew of measures towards this end. The GoI is computerizing the courts and making them ICT enabled. This will allow the courts to move away from manual functioning to e-functioning and provide e-services to the people. It is also investing on judicial infrastructure. The Government has also initiated the Gram Nyayalaya scheme which supports the States to set up courts at the grassroot level with a view to take justice to the doorsteps of the people.
A key forward-looking initiative of the Department of Justice is the setting up of the National Mission for Justice Delivery and Legal Reforms with the twin objectives of a) Increasing access by reducing delays and arrears in the system, and b) Enhancing accountability through structural changes and by setting performance standards and capacities.
The Mission, which is chaired by the Hon’ble Union Minister of Law and Justice, has identified 5 strategic initiatives to achieve its goals:
Policy and Legislative Changes;Re-engineering Procedures & Alternate Methods of Dispute Resolution;Focus on Human Resource Development;Leveraging ICT for better Justice Delivery; andImproving Infrastructure.The UNDP supported ‘Increasing Access to Justice for Marginalised People” Project (2013-2017) has two major components: Legal Empowerment (LEP) and embedded technical support for the National Mission on Justice Delivery and Legal Reforms (JDLR). The Project Manager will head the Project Management Team of the LEP component. S/he will work under the direct supervision of Project Coordinator and will report to the National Project Director (NPD) and Programme Officer, UNDP.

Senior Architect-Enhancing Legal and Electoral Capacity for Tomorrow - (ELECT-II) - Kabul
Scope of WORK, Expected Outputs And Deliverables:
The Senior Architect will be responsible for the architectural design of an array of buildings for the Headquarters Compound of the IEC in Kabul (see deliverables). Furthermore, s/he shall provide advice and guidance to the ELECT construction unit consisting of ten national engineers as well as the IEC engineering unit.
Design opportunities will include development and refinement of a Campus Master Plan, and may include the general improvements of the grounds, the design of ancillary structures as well as renovations of existing structures.
It is expected that the Senior Architect:
Expected Deliverables for phase / year one:
The sequence of the provision of deliverables may vary as conditions vary. Establishment and adjustment of sequence to be done in agreement with IEC senior management and UNDP ELECT II supervisor.
Provide guidance and advice to UNDP ELECT II construction unit and the IEC engineering unit in their efforts to design and construct offices, warehouses, infrastructure and security upgrades for IEC regional operations and the IEC Headquarters Compound.
Deliverables
Monthly report commenting on progress, projections and needs of the projects and the design team in conjunction with the coordinator of the UNDP ELECT II construction unit. Provision of deliverables (hand-over of design work) will be supervised by Head of Pillar one.
Design Project 1 - Master Plan – Verify/Confirm IEC HQ Site Master Plan (generated as necessary, in consultation with key User/Stakeholders). Provide update(s) of Master Site Plan as each building is developed (1 month). Deliverable – An Updated HQ Compound Master Site Plan;
Design Project 2 - Data Center – Architectural design for new construction of a data entry and tallying center - area between 1200 and 1600 sq. meters (3 months). Deliverables – Verified/Updated Architectural Space Program and Schematic Design Documents, Design Development Documents, Tender Documents (includes Drawings, BoQ, Cost Estimate and Specifications);
Design Project 3 - Office Building for Elections Commission/Secretariat – Architectural design for new construction - area between 1600 and 2400 sq. meters (3 months). Deliverables – Architectural Space Program, Schematic Design Documents, Design Development Documents, Tender Documents (includes Drawings, BoQ, Cost Estimate and Specifications);
Design Project 4 – Training Center – Architectural design for renovation and addition - area between 1000 and 1600 sq. meters (1 month). Design Training Sessions with IEC engineers - Training and Review Sessions on Design Considerations with regard to functional program, safety, security and campus planning, preparation of tender documents (8 two-hour sessions). Deliverables – 8 two-hour training sessions; report on sessions and the key concepts and practices presented (Review of Master Site Planning, Design for each building – Key Concepts covered).
PRICE PROPOSAL AND SCHEDULE OF PAYMENTS:
Price proposal and schedule of payments:
Applicants have to provide a technical and a financial proposal.
The technical proposal shall describe the methodology and the approach to fulfill the required deliverables as well as outline the major components (and/or sub-deliverables) in the development of the designs.
Financial proposal – Lump Sum per Deliverable (plus living allowance and transportation).
As an Individual Consultant Contract, this is a deliverables based contract. The Financial Proposal should specify prices per deliverable, which may be subdivided to reflect the percentage of completion of each deliverable (design phase). In addition, the proposal should articulate a living allowance (day/night) to be paid for time spent in Afghanistan.The consultant will report directly to the Head of Pillar One of ELECT II (unless and until the project until is re-organized);The consultant will work closely with UNDP ELECT II Engineering and Architecture Personnel in the ELECET II Construction Unit;The consultant will mentor the IEC Engineering Team using the design effort for the IEC Compound as instructional material;UNDP ELECT II project will provide office space, A3/A4 color printer and color A0/A1 Plotter within the ELECT II Project Office;UNDP ELECT II will provide licensed CADD software compatible with ELECT II Construction Team and IEC Engineering Team; The consultant will be provided with I.C.T. equipment (laptop, large screen (desktop) monitor, mobile phone, mobile radio) and security devices (personal body armor and helmet) and will be fully included in the UNDP Security regime; UNDP will secure accommodation at one of the following MOSS Compliant locations (costs covered by consultant): UNOCA Compound or the Green Village Compound. The consultant must take accommodation at one of these two locations due to security directives;UNDP will provide transport from the accommodation to the office and return. The consultant will provide the services for the duration of 12 months with the possibility of further extension of contract based on operational need of UNDP ELECT II.
The Consultant will be based in Kabul, Afghanistan.Evaluation and method and criteria:
The award of the contract will be made to the individual consultant whose offer has been evaluated and determined as:
Responsive/compliant/acceptable, and;Having received the highest combined score out of a pre-determined set of weighted technical and financial criteria specific to the solicitation.Technical Criteria Weight – 70%.
Financial Criteria Weight – 30%.
The offer will be evaluated by using the Best Value for money approach (combined scoring method – using the 70% - 30% distribution for technical and financial proposals, respectively).
Technical - 100%:
Relevance of Education (Advanced Degree in relevant field) - 5%;Experience related to the required services - 10%; Description of approach/methodology to assignment - 20%; Assessment of previous design work - 10%; Interview Result - 55%. Financial - 30%
The assignment is based on a lump sum contract amount and payment is based only upon certification and acceptance of the deliverables and/or monthly reports received as indicated above. In the event of non-performance and pre-termination where payments cannot be made in full or may have to suspended, the final payment will be pro-rated against received and accepted deliverables.

Financial proposal
The financial proposal shall specify a total lump sum amount, and payment terms around specific and measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the services specified in the TOR. In order to assist the requesting unit in the comparison of financial proposals the financial proposal shall include a breakdown of this lump sum amount (including fee, taxes, travel, per diems, and number of anticipated working days).
Travel
All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty station/repatriation travel. In general, UNDP should not accept travel costs exceeding those of an economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own resources.
In the case of unforeseeable travel, payment of travel costs including tickets, lodging and terminal expenses should be agreed upon, between the respective business unit and Individual Consultant, prior to travel and will be reimbursed.
Up to two travel missions are envisaged under this assignment, with a minimum 18 working days in Moldova.

International Consultant on Legal Framework for the Roadworthiness Tests for Motor Vehicles and their Trailers - Chisinau
Relations between the Republic of Moldova (RM) and the European Union (EU) formally started with the signing of the Partnership and Cooperation Agreement (PCA) in 1994 that entered into force in 1998. The PCA established the basic principles of cooperation between RM and EU and was designed for a 10 year period.
The Partnership and Cooperation Agreement will soon be replaced by an Association Agreement which includes a Deep and Comprehensive Free Trade Area (DCFTA). The documents provide for political association and economic integration and have been initialed in Vilnius in November 2013.
For the Republic of Moldova the AA represents a reform agenda which is based on a comprehensive program of legal harmonization with EU norms.
Exceeding the classical arrangements of free trade, DCFTA provides not only a mutual opening of markets for most goods and services but requires a gradual rapprochement of norms and standards such as quality standards and rules, sanitary rules, intellectual property rights, trade facilitation, public procurement and competition, energy trade and other.
Except for European Economic Area and EU candidate states, never before has the EU opened its internal market to such an extent to a third country. This reality is possible due to the commitment of the Republic of Moldova to take over the acquis communautaire.
In exchange to effective implementation of EU legislation Moldova will gradually become part of the EU internal market.
A deeper economic integration through DCFTA will boost the country's economic growth, will create business opportunities and promote real economic modernization and integration into the EU. The direct result of establishing free trade area with EU is that citizens will benefit from higher quality and safer goods and services while manufacturers will be supported to access international markets.
UNDP and its international partners are committed to assist Moldova, through technical and financial assistance, in promoting costly legal and institutional reforms that DCFTA entails.
The Project “Building Institutional Capacity of the Ministry of Foreign Affairs and European Integration (MFAEI)” aims at strengthening the institutional capacity of the MFAEI as lead institution in the AA negotiation process.
In the same context, the Project seeks to contribute to developing EU integration capacities of key line ministries through aligning relevant policies, administrative and institutional arrangements, legislation, procedures and best practices to EU standards and requirements.
Roadworthiness tests for motor vehicles and their trailers in the Republic of Moldova are performed by 76 vehicle testing centers. All of them are private owned and authorized and supervised by the Ministry of Transport and Road Infrastructure (MTRI) and National Road Transport Agency. The Government Decision Nr.1047 from 8.11.1999 provides legal framework for roadworthiness tests and describes the procedures and requirements.Many of the requirements of the Directive 2009/40/EC are already met in Government Decision Nr.1047. MTRI started to prepare amendments to this Decision and Law Nr.131 on Road Traffic Safety to ensure full compliance with the Directive 2009/40/EC. In addition, there is a need to specify the requirements for the technical condition of vehicles and equipment and the requirements for the assessment because no such requirements are specified in the Moldovan legislation.
Technical assistance to the Ministry of Transport and Road Infrastructure and National Road Transport Agency (hereinafter – the Beneficiaries) is needed to revise existing legislation and draft amendments prepared, revise operational practice of the Beneficiaries and prepare necessary legislative and operational acts for the full compliance with the EU requirements (Directive 2009/40/EC) and best practices in this field.
