LEGAL MANAGER - LITIGATION

Reporting to the Head, Legal Services; the job-holder will be responsible for managing potential litigation issues as well as litigation cases filed by or against the Bank to ensure that the Bank’s interests are not prejudiced either before court, in the public domain or business environment.
 Key Responsibilities:
  • Conduct legal research, investigation, collate evidence, preparation of witnesses for pre-trial and hearing, develop concept papers, prepare legal briefs and opinions as well as develop effective defence strategies. arguments and testimony in preparation for legal proceedings of cases in liaison with external lawyers;
  • Representing the Bank before any court or tribunal as a witness or to watch brief as necessary;
  • Assist in the pursuit of amounts due to the Bank including trough the preparation and issuance of statutory notices for sale issued under the Land Act, 2012 and ensure adequate and timely follow-up on the same, to enable the Bank realize its securities. 
  • Managing and measure external lawyers performance to ensure efficiency;
  • Managing litigation costs to a minimum including but not limited to negotiating suitable settlements in favour of the Bank where deemed appropriate;
  • Creating legal awareness and providing advice to the Bank on suitable courses of action to avert and/or minimize litigation;
  • Scrutinize legal fees and ensuring the same are raised in accordance with the Remuneration Order;
  • Manage the database of all Bank litigation to ensure the same is consistently up-to-date;
  • Prepare relevant reports, presentations and analysis of the Bank litigation quarterly and as required by the Board.
The Person
  • Law degree from a reputable university
  • Advocate of the High Court of Kenya with a current practicing license
  • CPS (K) Certified Public Secretary Kenya, Commissioner for oaths and Notary Public will be an added advantage.
  • Master’s degree will be an added advantage
  • A Minimum of 5 years post-admission experience in a busy law firm or financial institution with hands on experience in commercial law and litigation.
  • Experience in a Banking/Financial institution will be an added advantage.
  • Good grasp of court and arbitration rules and procedures
  • Must be analytical with good management skills and ability to work with minimum supervision
  • Must have the ability to prioritize work and deliver high quality output within tight deadlines
  • Must be resourceful, creative and has high follow-through ability.
  • Should have excellent organizational skills and computer skills.
